These terms govern your use of heyly.co (the “Service”). By using the Service, you agree to them. If you use the Service on behalf of a business, you agree on that business’s behalf.
Use of the service
The Service provides an AI-powered receptionist that answers calls, chats, and text messages, and can book calendar appointments on your behalf. It is provided as-is, without warranty of any kind.
Your responsibilities
You are responsible for how you use the Service and for complying with the laws that apply to your business, including:
- Call recording & AI disclosure. Many jurisdictions require notifying callers that a call is recorded and/or handled by an automated system, and some require the consent of all parties. You are responsible for providing any legally required notice and obtaining any required consent. The Service offers an optional setting that has the receptionist state it is an automated assistant and that the call may be recorded; enabling and configuring it appropriately is your responsibility.
- Telephony & messaging laws. You are responsible for compliance with applicable telemarketing, TCPA, A2P/10DLC, and similar rules for the numbers and messages you use.
- Your customers’ data. You must have a lawful basis to collect and process the information callers provide, and to share it with the Service.
- Accurate business information. Keep your business profile (hours, services, pricing) accurate; the receptionist answers from what you provide.
- No unlawful or prohibited use. Do not use the Service to harass, defraud, or violate the rights of others.
AI-generated responses
Responses are generated by a large language model and may be inaccurate, incomplete, or unexpected. The Service can misunderstand a caller, book or fail to book an appointment incorrectly, or produce responses you would not have given. Do not rely on the Service for emergencies or time-critical, medical, legal, financial, or safety decisions. You are responsible for reviewing outcomes that matter to your business.
Our role in processing data
For the information your callers and customers provide through the Service, you act as the controller of that data and the operator of the Service acts as a processor handling it on your behalf and on your instructions. To provide the Service, that data may be sent to third-party providers (see the Privacy Policy). You are responsible for the notices and consents needed for this processing.
No warranty
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or accurate.
Limitation of liability
To the maximum extent permitted by law, the operator of the Service is not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, missed appointments, incorrect information, or service downtime. To the extent liability cannot be excluded, it is limited to the amount you paid for the Service in the three months before the claim.
Indemnification
You agree to indemnify and hold harmless the operator of the Service from claims, damages, and expenses arising out of your use of the Service, your violation of these terms or of any law, or a claim by one of your callers or customers relating to your use of the Service (including recording, disclosure, or consent).
Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these terms or use the Service unlawfully.
